Funktion Leisure Limited, trading as MakeHampers ("we", "us" or "our"), respects your privacy and is committed to protecting your personal data. This privacy policy explains how we look after your personal data when you visit our website, place an order, contact us or otherwise deal with us, and tells you about your privacy rights and how the law protects you.

Your right to complain
You have the right to make a complaint at any time to the Information Commissioner's Office (ICO), the UK supervisory authority for data protection issues (https://ico.org.uk). We would, however, appreciate the chance to deal with your concerns first, so please contact us in the first instance.
Changes to this policy
We keep this policy under regular review. It is important that the personal data we hold about you is accurate and current; please keep us informed if your personal data changes during your relationship with us.

Our website may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements.
2. The data we collect about you
Personal data means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data). We may collect, use, store and transfer the following kinds of personal data:
- Identity Data: first name, last name, title and, where you tell us, date of birth.
- Contact Data: billing address, delivery address, email address and telephone number.
- Recipient Data: where you send a gift to someone else, the name, delivery address and any gift message you provide for that recipient.
- Financial Data: payment method details (card and other payments are handled by our payment providers, see below; we do not store full card details ourselves).
- Transaction Data: details of the orders you have placed, payments to and from you, and deliveries.
- Technical Data: internet protocol (IP) address, login data, browser type and version, time zone and location, operating system and platform, and other technology on the devices you use to access our website.
- Profile Data: your username and password, orders and wish lists, your interests, preferences, feedback and survey responses.
- Usage Data: information about how you use our website and services.
- Marketing and Communications Data: your preferences in receiving marketing from us and your communication preferences.
We also collect, use and share Aggregated Data such as statistical or demographic data. Aggregated Data is not personal data in law as it does not directly or indirectly identify you.
Sending a gift to someone else
When you order a gift for another person, you provide us with their name and delivery address so that we can deliver the order. We use that information only to fulfil and deliver the gift. Please make sure you have that person's agreement to share their details with us for this purpose.
Children
Our website and products are intended for adults, and some of our hampers contain alcohol, which we only sell to and deliver to people aged 18 or over. We do not knowingly collect personal data directly from children.
3. How your personal data is collected
We use different methods to collect data from and about you, including:
- Direct interactions: when you place an order, create an account, join our newsletter, enter a competition or survey, or contact us by phone, email, live chat or post.
- Automated technologies: as you interact with our website we automatically collect Technical and Usage Data using cookies and similar technologies. See our cookie policy for details.
- Third parties: we may receive Technical and Usage Data from analytics and advertising providers such as Google and Meta; and Contact, Financial and Transaction Data from our payment providers. Our advertising partners include Google, Meta, TikTok, Pinterest and Reddit.
4. How we use your personal data
We will only use your personal data when the law allows us to. Most commonly we rely on one or more of the following lawful bases: performance of a contract with you; our legitimate interests (where these are not overridden by your rights); compliance with a legal obligation; and your consent (for example for certain marketing and advertising activities). 4.1 Marketing
We may use your Identity, Contact, Profile, Usage and Marketing Data to decide which of our products and offers may be relevant to you. You will receive marketing from us where you have bought from us or shown interest and have not opted out, or where you have given consent. You can opt out at any time using the unsubscribe link in any marketing message or by contacting us. Opting out of marketing will not affect service messages relating to an order.
4.2 Cookies and analytics
We use cookies and similar technologies to operate our website, understand how it is used and measure our advertising. You can control non-essential cookies through our cookie and consent preferences, or set your browser to refuse some or all cookies. If you disable cookies, some parts of our website may not function properly. See our cookie policy for details of the specific cookies we use and how to manage them.
4.3 Change of purpose
We will only use your personal data for the purposes for which we collected it, unless we reasonably consider we need to use it for a compatible purpose. If we need to use it for an unrelated purpose, we will notify you and explain the lawful basis.
4.4 Advertising and audience matching
We advertise online to reach existing and potential customers, including through Google, Meta (Facebook and Instagram), TikTok, Pinterest and Reddit. To make our advertising more relevant and to control who sees it, we may share a limited amount of contact information (such as your email address or telephone number) with these platforms in a hashed form. "Hashed" means the information is converted into an irreversible, pseudonymised code before it is shared. The platforms match this against their own account holders in order to show our advertising to you, or to people with characteristics similar to our customers ("lookalike" or "similar" audiences), and to exclude existing customers from campaigns aimed at finding new customers.
Where the law requires it, we rely on your consent for this activity, which you can withdraw at any time through our cookie and consent preferences or by contacting us. Where we rely on our legitimate interests, you have the right to object at any time. When we upload hashed data for matching, the platforms are required to use it only to carry out the match and in accordance with their own terms (for Google, its Customer Match policies, and for Meta, its Custom Audiences terms). We do not share your data with these platforms for their own independent marketing purposes.
5. Disclosures of your personal data
We may share your personal data with the categories of recipient below. Where we name a specific provider we do so as an example only; we may use other providers of similar services, and the providers we use may change from time to time.
- Our payment providers, which process card and other payments securely (including services such as Apple Pay and Google Pay, and buy-now-pay-later providers). We do not store full card details ourselves.
- Our fulfilment and delivery partners, who pack and dispatch your order and deliver it to you or your chosen recipient.
- Technology providers that host our systems and support our operations, and our email and marketing platform.
- Analytics and advertising platforms, for example Google, Meta (Facebook and Instagram), TikTok, Pinterest and Reddit, including for the audience-matching activity described in section 4.4.
- Professional advisers including lawyers, bankers, auditors and insurers.
- HM Revenue and Customs, regulators and other authorities where we are required to report.
- Third parties to whom we may sell, transfer or merge parts of our business or assets; if so, the new owners may use your personal data as set out in this policy.
We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our service providers to use your personal data for their own purposes and only permit them to process it for specified purposes and in accordance with our instructions.
6. International transfers
Some of our service providers are based outside the UK, so your personal data may be transferred outside the UK. Whenever we transfer personal data out of the UK, we ensure a similar degree of protection by relying on an appropriate safeguard, such as a UK adequacy decision for the destination country, the International Data Transfer Agreement (or the UK Addendum to the EU Standard Contractual Clauses), or another lawful transfer mechanism. Please contact us for further information on the safeguards we use.
7. Data security
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. We limit access to your personal data to those who have a business need to know, and they are subject to a duty of confidentiality. We have procedures to deal with any suspected personal data breach and will notify you and any applicable regulator where we are legally required to do so.
8. Data retention
We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including to satisfy any legal, tax, accounting or reporting requirements, and to resolve disputes. By law we must keep basic information about customers (including Contact, Identity, Financial and Transaction Data) for six years after an order for tax purposes. We may retain information for longer where necessary to establish, exercise or defend legal claims. In some circumstances we will anonymise your data for research or statistical purposes, in which case we may use it indefinitely without further notice. You can ask us to delete your data in certain circumstances (see section 9).
9. Your legal rights
Under data protection law you have the following rights in relation to your personal data:
- Request access to your personal data (a "subject access request").
- Request correction of your personal data.
- Request erasure of your personal data.
- Object to processing of your personal data, including for direct marketing.
- Request restriction of processing of your personal data.
- Request transfer of your personal data (data portability).
- Withdraw consent at any time where we rely on consent.
You will not usually have to pay a fee to exercise your rights. We may need to verify your identity before responding to your request, to make sure personal data is not disclosed to anyone who has no right to receive it. We try to respond to all legitimate requests within one month; occasionally it may take longer if the request is complex, in which case we will keep you updated. 10. Automated decision-making
We do not make decisions about you based solely on automated processing that produce legal effects concerning you or that similarly significantly affect you. Some of our website and advertising tools use automated processing to show relevant content and advertising, but this does not have legal or similarly significant effects on you.
11. Glossary of lawful bases
Legitimate interests: the interest of our business in conducting and managing it to provide you with the best products, service and a secure experience. We balance any impact on you and your rights before processing on this basis, and we do not use your data where our interests are overridden by the impact on you (unless we have your consent or are otherwise permitted by law).
Performance of a contract: processing your data where it is necessary to perform a contract with you, or to take steps at your request before entering into a contract.
Legal obligation: processing your data where it is necessary to comply with a legal or regulatory obligation.
Consent: your clear, affirmative agreement to a specific use of your data, which you can withdraw at any time.
